New York State to Remove Tampon Sales Tax in Favor of Gender Equality

On Wednesday, the New York State Assembly finalized a proposed bill that would remove the state sales tax from female hygiene products such as sanitary napkins and tampons. The New York State Senate unanimously passed the bill yesterday while Governor Andrew Cuomo is expected to sign it into law.

“Repealing this regressive and unfair tax on women,” said New York Governor Andrew Cuomo (D), “is a matter of social and economic justice. I look forward to signing it into law.”

The legislation was spurred on by a class action lawsuit brought against the New York state tax department by five women this past March. The women claimed that the tax on female hygiene products violated the equal protection clause in the U.S. Constitution. Their claim is that the state makes $14 million a year on the 4 percent sales tax that it attaches to such products.

Those who supported the legislative action, like the bill’s sponsor, State Senator Susan Serino believe that female hygiene products should be treated as what they termed “necessities” like medicine or other health care items that are not currently subject to the state’s sales tax.

“There are many issues that simply transcend politics,” said Serino, “and unanimous votes in both houses tells you that this is certainly one of them.”

Ten other states are currently considering such legislation and five other states, Minnesota, Massachusetts, New Jersey, Maryland and Pennsylvania already have tax exempt laws in place for female hygiene products.

Serino concluded that, “Moving this legislation forward is a win for consumers and it’s a win for women who have largely shouldered the burden of the tax for generations.”
